SECTION 1: SCOPE OF THE SERVICE

1.1. Definition of the Company

Gruso is a new-generation mobile travel assistant that optimizes traditional and fragmented travel-planning processes through artificial intelligence and smart algorithms, offering its users personalized solutions. All digital services offered on our Platform are provided by [Company's registered name] (in short, the "Company").

1.2. Scope of the Service

Gruso is designed to transform travel planning from a research task that takes hours and creates stress into an enjoyable experience that takes only minutes. To this end, our Platform brings together the following services (the "Services") under a single roof:

Personalized Smart Travel Assistant: Analyzing the data shared by the user regarding where, when and what kind of trip they want, along with their personal tastes and areas of interest, it prepares fully personalized trip plans (including flights, accommodation, places to visit, dining venues and seasonal events).
Simplified Collaborative Travel Planning (Group and Poll System): It enables users to create groups of friends, invite participants to these groups, and organize single- or multiple-choice votes (polls) on matters such as destination, date or activity selection. In line with the principle of transparency, the Platform reports to group members in real time, via reports and notifications, who voted for what and the poll results.
Dynamic Budget Management and Saving Tips: It produces travel and accommodation suggestions that fit the lower-upper budget limits set by groups or individual users; it breaks the total cost down into its items (flight, accommodation, food, activity) and presents it with detailed charts, daily breakdowns and budget-saving tips.
Smart Packing List: By synthesizing the dynamic weather forecasts of the destination on the relevant dates, the planned activities and the user's personal needs, it creates ready and smart luggage lists categorized from clothing to electronics, from documents to health equipment.

1.3. Our Legal Status and Limits of Our Liability (Critical Notice)

The legal status and the limits of liability of Gruso are subject to the following rules:

Absence of Agency and Sales Activity: Gruso is not a travel agency, tour operator, ticketing site or accommodation provider. Our Platform is an intermediary digital assistant that compiles and optimizes the travel options offered by third parties for you.
Third-Party Travel Products: The flight, hotel, car rental, restaurant or event reservations ("Third-Party Travel Products") that appear before you, are recommended or to which you are directed through our Services are offered entirely by independent travel agencies, airlines, hotels or tour operators ("Travel Service Providers").
Disclaimer of Liability: Gruso cannot be held directly or indirectly responsible for the pricing, availability checks, reservation processes, cancellation/refund transactions or the quality/defects of the service offered with respect to said Third-Party Travel Products. All of these transactions are subject to the relevant third party's own terms, conditions and privacy policies.
Estimated and Dynamic Data: The weather forecasts, real-time event hours and budget analysis tips provided by the Platform are for informational purposes, and Gruso does not warrant the absolute accuracy and unchangeability of this data.
Absence of Continuity Guarantee: Gruso does not guarantee that the Services and the Platform will be uninterrupted, error-free or accessible at all times, 24/7. The services offered through the Platform may be interrupted, suspended or completely terminated temporarily or permanently due to technical infrastructure requirements, server loads or updates. The user accepts to benefit from the service knowing this structure of the Platform.
Third-Party API and Infrastructure Outages: Gruso depends on third-party infrastructure providers and API (Application Programming Interface) systems for artificial intelligence models, map integrations, weather forecasts and travel data. Our company cannot be held responsible for disruptions that may occur on Gruso due to technical failures, slowdowns, restrictions or outages occurring in the systems of said third parties.
Maintenance and Force Majeure: In cases of planned or unplanned maintenance/repair work, cyber attacks, global/local outages arising from network and internet providers, natural disasters, war, government restrictions and other force majeure situations, Gruso bears no legal or criminal liability for the inability to provide the service.
Right to Change Features and Limits: In line with artificial intelligence cost limits, database limits and operational requirements, Gruso reserves the right to unilaterally change, remove or restrict the features, usage limits, subscription tiers (tier limits) or API usage limits within the Platform, with or without prior notice. The user cannot claim any right or compensation due to these changes.

SECTION 2: TERMS OF USE, LICENSE AND USER OBLIGATIONS

2.1. Membership, Account Security and Age Limit

Account Security: In order to benefit from the personalized travel assistance, budget management and group features offered by the Platform, users must create an account. The user is personally responsible for protecting the confidentiality of the account password and access information. If you notice or suspect that the security of your login information has been compromised, you must immediately notify us through Gruso support channels.
Age Limit: Our Services and Platform are not designed for children under the age of 18. No one under the age of 18 may provide personal information to the Platform. As Gruso, we do not knowingly collect personal data from children under the age of 18; if such a situation is detected, said data will be deleted immediately in accordance with our Privacy Policy.

2.2. The License Granted to You and Purpose of Use

In return for your acceptance of these Terms, Gruso grants you a non-transferable, non-exclusive and revocable license granting you the right to download, access and use the Platform solely for personal and non-commercial purposes. This license is granted on the condition that you fully comply with the legal obligations and restrictions set out below.

2.3. Prohibited Activities and Platform Security

You may use the Platform and the Services only in accordance with applicable laws and for legitimate purposes. Carrying out the following actions is deemed an express and serious breach of this agreement:

Inappropriate and Harmful Content: Publishing, sharing or transmitting, in group plans or polls, any material that is illegal, harmful, defamatory, offensive, obscene, constitutes a violation of privacy, or infringes the copyright, trademark or other intellectual property rights of a third party;
Reverse Engineering and Conversion to Source Code: Disassembling, reverse engineering or attempting to convert into source code the software, algorithms, applications or updates offered through the Platform, except in mandatory cases legally permitted;
Breaching Security Measures: Copying, selling, renting or lending the Platform, or attempting to breach or circumvent any security measure implemented to limit your access or use;
Sabotaging the System: Transmitting "denial of service" (DoS/DDoS), viruses, worms, trojan horses or malicious code in a manner that could damage, disable, overload, weaken or endanger our systems or our security;
Intellectual Property Infringement: Removing, altering, substituting copyrights, trademarks, trade names, logos or other marks of origin belonging to Gruso, or attempting to present the Platform as the product of a party other than Gruso;
Third-Party Platform Terms: If any function or part of Gruso is hosted on, or works integrated with, a third party's website/application (for example Google, Apple, Facebook or other social media/map sites), you agree to comply, in addition to these Terms, with the terms of use of said third parties.

Automated Data Scraping and Bot Prohibition

Gruso has made a significant investment in data processing and presentation infrastructure to create travel routes, prepare budget breakdowns and develop smart algorithms.

You agree not to scrape, copy, index, rank or otherwise exploit the Platform or the data within it by using any unauthorized automated computer program, software tool, bot, crawler, spider or other software or application.
Any breach of this provision is deemed a serious breach of these terms, and Gruso reserves the right to take any technical, administrative and legal measures (including material/moral compensation) to detect, restrict and prevent unauthorized automated access.

2.5. Group Interaction, Smart Poll and Collaborative Planning Rules

Invitation Responsibility: Users may create collaborative planning groups and invite their friends. When sending an invitation (SMS, e-mail or in-platform referrals), you accept that you are authorized to share the contact information of the invited persons and that you have obtained their consent. The legal responsibility for invitations made without obtaining permission belongs to the User who sent the invitation.
Principle of Transparency (Polls): In order to clarify the joint decision-making mechanism, in in-group votes (destination, date, activity selection, etc.) the option you voted for and your profile name can be clearly viewed by the other participants in the group. A user who joins a group and votes in polls is deemed to have accepted this transparency in advance. During poll processes, real-time notifications (push notifications) are sent to group members; users may manage these settings from their devices.
Limit of Liability for Budget and Packing Estimates: The budget charts, saving tips and smart packing lists provided by the Platform are entirely estimative and auxiliary in nature. Gruso cannot be held responsible for budget overruns, travel disruptions and material/moral differences that may arise due to exchange rate fluctuations, instant price changes by third-party companies, additional taxes or sudden weather changes.

SECTION 3: INTELLECTUAL PROPERTY, FEEDBACK AND CONTENT COMPLAINTS

3.1. Gruso's Ownership (Intellectual Property Rights)

Unless expressly stated otherwise in these Terms; all software (including artificial intelligence algorithms and source codes), designs, interfaces, patents, trademarks, logos, trade names, design rights, database rights, know-how, trade secrets and copyrights (collectively the "Intellectual Property Rights") within the Platform and the Services belong exclusively to Gruso or are licensed to Gruso.
By using the Platform, the user does not acquire any title, ownership or interest in these rights; they only have the limited and personal use license defined in Section 2.2. You absolutely have no right to access the Platform in source code form.

3.2. User Feedback

You accept that you assign to Gruso fully, indefinitely and irrevocably any and all suggestions, comments, ideas, improvements or feedback ("Feedback") that you submit to us in order to improve the Platform.
Gruso has the right to use, develop and share said Feedback for any commercial or corporate purpose at its own discretion, without being subject to any royalty, restriction or permission mechanism.

3.3. Third Parties' Rights and Reports of Illegal Content

Gruso respects the intellectual property rights of others and the laws. If you believe that your copyrights have been infringed or that there is illegal content (hate speech, insult, fraud, discrimination, etc.) in group plannings, polls or user content, you must notify us immediately at [Support/notice email address].
Your notice notification must include a clear description of the work/content allegedly infringed, where it is located in the application (screenshot or group information), and current information through which we can contact you. In response to justified and lawful notices, Gruso will take the necessary steps to promptly remove said content.

SECTION 4: DISCLAIMER OF WARRANTIES, RESERVATIONS AND LIMITATION OF LIABILITY

4.1. Disclaimer of Warranties (Provision of the Service "As Is")

Risk of Use: Your use of Gruso and the Services it offers is entirely at your own responsibility. The Platform is provided to you on an "as is" and "as available" basis.
Absence of Accuracy Guarantee: Although we make our utmost effort to keep travel data, prices and routes up to date; we give no express or implied warranty whatsoever as to the absolute accuracy, completeness or reliability of content, budget estimates and smart packing advice obtained in real time from Third-Party Travel Providers (airlines, hotels, etc.) or meteorological stations.
To the maximum extent permitted by applicable law, Gruso expressly disclaims all implied warranties such as title, non-infringement, merchantability, fitness for a particular purpose and accuracy. No undertaking is given that the Platform will at all times be uninterrupted, secure, error-free or free of viruses.

4.2. Travel Planning and Reservations Through Gruso

Intermediary Role: As also stated in Section 1, Gruso is not a travel agency. It does not set or control the prices of the flights, accommodation or events listed on the Platform. Even though it makes facilitating referrals for reservation transactions, these transactions take place directly between you and the relevant Travel Service Provider (airline company, hotel, etc.).
Compliance with Provider Terms: You are obliged to fully comply with the terms and conditions (cancellation, refund, baggage rules, etc.) of the company from which you make a purchase. In the event of the cancellation of your ticket or the accrual of additional charges due to the breach of these rules, Gruso has no legal liability or mediation duty.
Linked Travel Arrangements: When you use the Platform to select separate products from different providers within 24 hours (for example, first a flight, then a hotel), this may not legally provide "Package Tour" protection. In the event of the bankruptcy or default of each service provider, you must seek your rights directly against that provider; Gruso is not a party at any stage of these processes.

SECTION 5: SUBSCRIPTION MODELS, PAYMENT AND EXCEPTION TO THE RIGHT OF WITHDRAWAL (REFUND)

5.1. Subscription Models and Pricing

Paid Services: While Gruso may offer some basic features for free, it offers artificial-intelligence-supported smart travel planning, in-group votes, detailed budget breakdowns and advanced assistance services within the scope of paid subscription models ("Premium / Pro Membership").
Price Changes: The fees, payment periods and scope of the subscription packages are determined by Gruso and announced on the Platform. Gruso reserves the right to make changes to the subscription prices. Price changes are not valid within the current subscription period and will be applied as of the renewal period.

5.2. Payment and Automatic Renewal

Payment Channels: Subscription payments are collected through in-app purchase channels (Apple App Store / Google Play Store billing systems) or secure third-party payment gateways determined by Gruso.
Automatic Renewal: Unless the user requests otherwise and cancels their subscription before the end of the period, subscriptions are automatically renewed according to the selected period (monthly/annual) and the subscription fee is collected from the registered payment method. You may cancel your subscription for the next period at any time through your relevant app store (App Store / Play Store) settings.

5.3. Absence of the Right of Withdrawal and Refund Policy (Critical Legal Notice)

Digital Content and Immediate Performance Exception: Pursuant to Law No. 6502 on Consumer Protection (Law No. 6502 on Consumer Protection) and subparagraph (ğ) of paragraph 1 of Article 15 of the Regulation on Distance Contracts; "contracts concerning services performed instantly in electronic media or non-material goods delivered instantly to the consumer" fall within the scope of the exceptions to the right of withdrawal.

Waiver of the Right of Withdrawal: The Premium travel assistance services offered by Gruso are performed instantly in electronic media and made available for the user's use upon the completion of the subscription transactions and the making of the payment. For this reason, the User accepts, declares and undertakes in advance that they have no right of withdrawal from the moment they start a Premium subscription and that they cannot request a refund of the subscription fee.
Partial Use/Cancellation Situation: In the event that the User cancels their subscription in the middle of the subscription period, no fee refund is made for the current period. The User may continue to use the Premium features until the end of the current subscription period; the subscription is not renewed for the next period.
App Store Rules: In cases where payments are made through the Apple App Store or Google Play Store, Gruso has no direct technical refund authority. The respective stores' own user agreements and refund policies apply.

SECTION 6: TERMINATION OF THE AGREEMENT, ENTRY INTO FORCE AND COMPETENT COURT

6.1. Termination of the Agreement and Suspension of the Account

Termination by the User: The user may unilaterally terminate this agreement at any time by completely deleting their Gruso account or removing the mobile application from their device. However, as stated in Section 5, in the event of the termination of an ongoing Premium subscription, no retroactive refund is made.
Termination and Suspension by Gruso: In the event that the User breaches any of the provisions of this agreement (in particular the bot/scraping prohibition, sharing of inappropriate content within a group, reverse engineering, etc.) or there is reasonable suspicion that they have breached it, Gruso has the right to temporarily suspend or permanently terminate the user's account without any notice and without paying compensation.
Complete Termination of the Service: Gruso reserves the right to completely cease the operations of the Platform and terminate the agreement for all users in line with commercial or operational decisions.

6.2. Entry into Force and Amendments to the Agreement

Entry into Force: This agreement enters into force with all its terms and conditions from the moment the User becomes a member of the Platform or starts using the Platform, and remains in force as long as the user account is active.
Amendments: Gruso may update the provisions of this agreement from time to time in line with changes in legal legislation or new features of the application. The updated agreement enters into force on the date it is published on the Platform. Significant changes made to the agreement will be notified to users through in-app notifications or e-mail. Your continued use of the Platform after the changes means that you accept the new terms.

6.3. Applicable Law and Competent Court

Applicable Law: The Law of the Republic of Turkey shall apply to the interpretation and implementation of this agreement and to the resolution of any and all disputes that may arise.
Competent Court and Enforcement Offices: In the resolution of any and all disputes arising from or in connection with this agreement, the Ankara Courts and Enforcement Offices are exclusively competent, without prejudice to the mandatory jurisdiction granted to the consumer courts by the legislation.

1.2. Hizmet Kapsamı

Gruso, seyahat planlamayı saatler süren ve stres yaratan bir araştırma işi olmaktan çıkarıp, dakikalar süren keyifli bir deneyime dönüştürmek amacıyla tasarlanmıştır. Bu doğrultuda Platformumuz aşağıdaki hizmetleri ("Hizmetler") tek bir çatı altında toplar:

Kişiselleştirilmiş Akıllı Seyahat Asistanı: Kullanıcının nereye, ne zaman ve nasıl bir seyahat istediğine dair paylaştığı verileri, kişisel zevkleri ve ilgi alanlarını analiz ederek tamamen kişiye özel gezi planları (uçuş, konaklama, gezilecek yerler, yeme-içme mekanları ve dönemsel etkinlikler dahil) hazırlar.
Kolaylaştırılmış Ortak Seyahat Planlaması (Grup ve Anket Sistemi): Kullanıcıların arkadaş grupları oluşturmasına, bu gruplara katılımcı davet etmesine ve destinasyon, tarih veya aktivite seçimi gibi konularda tekli veya çoklu seçimli oylamalar (anketler) düzenlemesine olanak tanır. Platform, şeffaflık ilkesi gereği kimin neye oy verdiğini ve anket sonuçlarını anlık olarak grup üyelerine raporlar ve bildirimler yoluyla iletir.
Dinamik Bütçe Yönetimi ve Tasarruf İpuçları: Grupların veya bireysel kullanıcıların belirlediği alt-üst bütçe sınırlarına uygun seyahat ve konaklama önerileri üretir; toplam maliyeti kalemlerine (uçuş, konaklama, yemek, etkinlik) bölerek detaylı grafikler, günlük dökümler ve bütçe tasarruf ipuçlarıyla sunar.
Akıllı Paketleme Listesi: Seyahat edilecek lokasyonun o tarihlerdeki dinamik hava durumu tahminlerini, planlanan aktiviteleri ve kullanıcının kişisel ihtiyaçlarını sentezleyerek; kıyafetten elektroniğe, belgelerden sağlık ekipmanlarına kadar kategorize edilmiş hazır ve akıllı bagaj listeleri oluşturur.

1.3. Yasal Statümüz ve Sorumluluk Sınırlarımız (Kritik Uyarı)

Gruso'nun yasal statüsü ve sorumluluk sınırları aşağıdaki kurallara tabidir:

Acentelik ve Satış Faaliyetinin Olmaması: Gruso bir seyahat acentesi, tur operatörü, biletleme sitesi veya konaklama sağlayıcısı değildir. Platformumuz, üçüncü taraflarca sunulan seyahat seçeneklerini sizin için derleyen ve optimize eden bir aracı dijital asistandır.
Üçüncü Taraf Seyahat Ürünleri: Hizmetlerimiz aracılığıyla karşınıza çıkan, önerilen veya yönlendirilen uçuş, otel, kiralık araç, restoran veya etkinlik rezervasyonları ("Üçüncü Taraf Seyahat Ürünleri"), tamamen bağımsız seyahat acenteleri, havayolları, oteller veya tur operatörleri ("Seyahat Hizmet Sağlayıcıları") tarafından sunulmaktadır.
Sorumluluk Reddi: Söz konusu Üçüncü Taraf Seyahat Ürünleri'nin fiyatlandırılması, müsaitlik durumunun kontrolü, rezervasyon süreçleri, iptal/iade işlemleri veya sunulan hizmetin kalitesi/kusurlarından Gruso doğrudan veya dolaylı olarak sorumlu tutulamaz. Bu işlemlerin tamamı, ilgili üçüncü tarafın kendi şart, koşul ve gizlilik politikalarına tabidir.
Tahmini ve Dinamik Veriler: Platform tarafından sağlanan hava durumu tahminleri, anlık etkinlik saatleri ve bütçe analizi ipuçları bilgilendirme amaçlı olup, Gruso bu verilerin mutlak kesinliğini ve değişmezliğini taahhüt etmez.
Süreklilik Garantisinin Olmaması: Gruso, Hizmetler'in ve Platform'un 7/24 kesintisiz, hatasız veya her an erişilebilir olacağını garanti etmez. Platform üzerinden sunulan hizmetler teknik altyapı gereksinimleri, sunucu yükleri veya güncellemeler nedeniyle anlık veya kalıcı olarak kesintiye uğrayabilir, askıya alınabilir veya tamamen sonlandırılabilir. Kullanıcı, platformun bu yapısını bilerek hizmetten faydalanmayı kabul eder.
Üçüncü Parti API ve Altyapı Kesintileri: Gruso; yapay zeka modelleri, harita entegrasyonları, hava durumu tahminleri ve seyahat verileri için üçüncü taraf altyapı sağlayıcılarına ve API (Uygulama Programlama Arayüzü) sistemlerine bağımlıdır. Söz konusu üçüncü tarafların sistemlerinde meydana gelen teknik arızalar, yavaşlamalar, kısıtlamalar veya kesintiler sebebiyle Gruso üzerinde yaşanabilecek aksaklıklardan şirketimiz sorumlu tutulamaz.
Bakım ve Mücbir Sebepler: Planlı veya plansız bakım/onarım çalışmaları, siber saldırılar, şebeke ve internet sağlayıcılarından kaynaklanan küresel/yerel kesintiler, doğal afetler, savaş, hükümet kısıtlamaları ve diğer mücbir sebep (force majeure) durumlarında hizmetin verilememesinden dolayı Gruso'nun hiçbir hukuki veya cezai sorumluluğu bulunmamaktadır.
Özellikleri ve Limitleri Değiştirme Hakkı: Gruso; yapay zeka maliyet limitleri, veri tabanı sınırları ve operasyonel gereklilikler doğrultusunda, Platform içerisindeki özellikleri, kullanım limitlerini, abonelik katmanlarını (tier limitleri) veya API kullanım sınırlarını önceden haber vererek veya vermeden tek taraflı olarak değiştirme, kaldırma veya kısıtlama hakkını saklı tutar. Kullanıcı, bu değişiklikler sebebiyle herhangi bir hak veya tazminat talebinde bulunamaz.

BÖLÜM 2: KULLANIM KOŞULLARI, LİSANS VE KULLANICI YÜKÜMLÜLÜKLERİ

2.1. Üyelik, Hesap Güvenliği ve Yaş Sınırı

Hesap Güvenliği: Platform'un sunduğu kişiselleştirilmiş seyahat asistanlığı, bütçe yönetimi ve grup özelliklerinden faydalanabilmek için kullanıcıların hesap oluşturması gerekmektedir. Kullanıcı, hesap şifresinin ve erişim bilgilerinin gizliliğini korumakla bizzat sorumludur. Oturum açma bilgilerinizin güvenliğinin ihlal edildiğini fark ederseniz veya bundan şüphelenirseniz, durumu derhal Gruso destek kanalları üzerinden bize bildirmelisiniz.
Yaş Sınırı: Hizmetlerimiz ve Platformumuz 18 yaşın altındaki çocuklar için tasarlanmamıştır. 18 yaşından küçük hiç kimse Platform'a kişisel bilgi sağlayamaz. Gruso olarak 18 yaşın altındaki çocuklardan bilerek kişisel veri toplamıyoruz; böyle bir durumun tespiti halinde söz konusu veriler Gizlilik Politikamıza uygun olarak derhal silinecektir.

2.2. Size Tanınan Lisans ve Kullanım Amacı

Bu Şartları kabul etmeniz karşılığında Gruso, size yalnızca kişisel ve ticari olmayan amaçlarla sınırlı olmak üzere, Platform'u indirme, erişme ve kullanma hakkını tanıyan; devredilemez, münhasır olmayan (gayriinhisari) ve geri alınabilir bir lisans verir. Bu lisans, aşağıda yer alan yasal yükümlülüklere ve kısıtlamalara tam olarak uymanız koşuluyla tanınmıştır.

2.3. Yasaklı Faaliyetler ve Platform Güvenliği

Platform'u ve Hizmetler'i yalnızca yürürlükteki yasalara uygun ve meşru amaçlar doğrultusunda kullanabilirsiniz. Aşağıdaki eylemlerin gerçekleştirilmesi bu sözleşmenin açık ve ağır bir ihlali sayılır:

Uygunsuz ve Zararlı İçerik: Yasa dışı, zararlı, karalayıcı, saldırgan, müstehcen, gizlilik ihlali oluşturan ya da üçüncü bir tarafın telif hakkı, ticari marka veya diğer fikrî mülkiyet haklarını ihlal eden herhangi bir materyali, grup planlarında veya anketlerde yayımlamak, paylaşmak veya iletmek;
Tersine Mühendislik ve Kaynak Koda Dönüştürme: Platform aracılığıyla sunulan yazılımları, algoritmaları, uygulamaları veya güncellemeleri yasal olarak izin verilen zorunlu durumlar haricinde parçalarına ayırmak, tersine mühendislik uygulamak veya kaynak koda dönüştürmeye çalışmak;
Güvenlik Önlemlerini İhlal Etme: Platform'u kopyalamak, satmak, kiralamak, ödünç vermek ya da erişiminizi veya kullanımınızı sınırlamak için uygulanmış herhangi bir güvenlik önlemini ihlal etmeye veya atlatmaya çalışmak;
Sistemi Sabote Etme: Sistemlerimize veya güvenliğimize zarar verebilecek, devre dışı bırakabilecek, aşırı yük bindirecek, zayıflatabilecek ya da tehlikeye atabilecek şekilde "hizmet engelleme" (denial of service - DoS/DDoS), virüs, solucan, truva atı veya kötü amaçlı kod iletmek;
Fikri Mülkiyet İhlali: Gruso'ya ait telif hakkı, ticari marka, ticari unvan, logolar veya diğer menşe işaretlerini kaldırmak, değiştirmek, yerlerine başkasını koymak veya Platform'u Gruso dışında başka bir tarafın ürünüymüş gibi göstermeye çalışmak;
Üçüncü Taraf Platform Şartları: Gruso'nun herhangi bir işlevi veya parçası üçüncü bir tarafın web sitesinde/uygulamasında (örneğin Google, Apple, Facebook veya diğer sosyal medya/harita siteleri) barındırılıyorsa veya buralarla entegre çalışıyorsa, bu Şartların yanı sıra söz konusu üçüncü tarafların kendi kullanım şartlarına da uymayı kabul edersiniz.

Otomatik Veri Tarama (Scraping) ve Bot Yasağı

Gruso; seyahat rotaları oluşturmak, bütçe dökümleri hazırlamak ve akıllı algoritmalar geliştirmek için veri işleme ve sunum altyapısına önemli bir yatırım yapmıştır.

Herhangi bir yetkisiz otomatik bilgisayar programı, yazılım aracı, bot, tarayıcı (crawler), örümcek (spider) veya diğer bir yazılım ya da uygulama kullanarak Platform'u veya içerisindeki verileri taramayı, kopyalamayı, dizine eklemeyi, sıralamayı ya da başka bir şekilde istismar etmemeyi kabul etmiş olursunuz.
Bu hükmün herhangi bir ihlali, bu şartların ciddi bir ihlali olarak kabul edilir ve Gruso, yetkisiz otomatik erişimi tespit etmek, kısıtlamak ve engellemek için her türlü teknik, idari ve yasal (maddi/manevi tazminat dahil) önlemi alma hakkını saklı tutar.

2.5. Grup Etkileşimi, Akıllı Anket ve Ortak Planlama Kuralları

Davet Sorumluluğu: Kullanıcılar ortak planlama grupları oluşturabilir ve arkadaşlarını davet edebilir. Davet gönderirken (SMS, e-posta veya platform içi yönlendirmeler), davet edilen kişilerin iletişim bilgilerini paylaşma konusunda yetkiniz olduğunu ve bu kişilerin rızasını aldığınızı kabul edersiniz. İzin alınmadan yapılan davetlerin yasal sorumluluğu daveti gönderen Kullanıcı'ya aittir.
Şeffaflık İlkesi (Anketler): Ortak karar mekanizmasını netleştirmek amacıyla, grup içi oylamalarda (destinasyon, tarih, aktivite seçimi vb.) hangi seçeneğe oy verdiğiniz ve profil adınız gruptaki diğer katılımcılar tarafından açıkça görüntülenebilir. Bir gruba katılarak anketlerde oy kullanan kullanıcı bu şeffaflığı peşinen kabul etmiş sayılır. Anket süreçlerinde grup üyelerine anlık bildirimler (push notifications) gönderilir; kullanıcılar bu ayarları cihazlarından yönetebilirler.
Bütçe ve Paketleme Tahminleri Sorumluluk Sınırı: Platform tarafından sunulan bütçe grafikler, tasarruf ipuçları ve akıllı paketleme listeleri tamamen tahmini ve yardımcı niteliktedir. Döviz kuru dalgalanmaları, üçüncü taraf firmaların anlık fiyat değişiklikleri, ek vergiler veya ani hava durumu değişimleri sebebiyle oluşabilecek bütçe aşımlarından, seyahat aksaklıklarından ve maddi/manevi farklardan Gruso sorumlu tutulamaz.

BÖLÜM 3: FİKRİ MÜLKİYET, GERİ BİLDİRİMLER VE İÇERİK ŞİKAYETLERİ

3.1. Gruso'nun Mülkiyeti (Fikri Mülkiyet Hakları)

Bu Şartlarda aksi açıkça belirtilmedikçe; Platform ve Hizmetler bünyesinde yer alan tüm yazılımlar (yapay zeka algoritmaları ve kaynak kodları dahil), tasarımlar, ara yüzler, patentler, ticari markalar, logolar, ticari unvanlar, tasarım hakları, veri tabanı hakları, bilgi birikimi (know-how), ticari sırlar ve telif hakları (topluca "Fikri Mülkiyet Hakları") münhasıran Gruso'ya aittir veya Gruso'ya lisanslanmıştır.
Kullanıcı, Platform'u kullanarak bu haklara dair hiçbir unvan, mülkiyet veya menfaat elde etmez; yalnızca Bölüm 2.2'de tanımlanan sınırlı ve kişisel kullanım lisansına sahip olur. Platform'a kaynak kodu formunda erişim hakkınız kesinlikle bulunmamaktadır.

3.2. Kullanıcı Geri Bildirimleri

Platform'u geliştirmek amacıyla bize ilettiğiniz her türlü öneri, yorum, fikir, iyileştirme veya geri bildirimi ("Geri Bildirim"), Gruso'ya tamamen, süresiz ve geri alınamaz şekilde devrettiğinizi kabul edersiniz.
Gruso, söz konusu Geri Bildirimleri herhangi bir telif ücreti, kısıtlama veya izin mekanizmasına tabi olmaksızın, kendi takdirine bağlı olarak ticari veya kurumsal her türlü amaçla kullanma, geliştirme ve paylaşma hakkına sahiptir.

3.3. Üçüncü Tarafların Hakları ve Yasa Dışı İçerik İhbarları

Gruso, başkalarının fikri mülkiyet haklarına ve yasalara saygı duyar. Grup planlamalarında, anketlerde veya kullanıcı içeriklerinde telif haklarınızın ihlal edildiğini veya yasa dışı (nefret söylemi, hakaret, dolandırıcılık, ayrımcılık vb.) bir içerik bulunduğunu düşünüyorsanız, durumu derhal [Destek/İhbar E-posta Adresi] üzerinden bize bildirmelisiniz.
İhbar bildiriminizde; ihlal edildiği iddia edilen eserin/içeriğin net tanımı, uygulamanın neresinde yer aldığı (ekran görüntüsü veya grup bilgisi) ve sizinle iletişim kurabileceğimiz güncel bilgiler yer almalıdır. Haklı ve hukuka uygun ihbarlara karşı Gruso, söz konusu içeriği süratle kaldırmak için gerekli adımları atacaktır.

BÖLÜM 4: GARANTİ FERAGATNAMESİ, REZERVASYONLAR VE SORUMLULUK SINIRLAMASI

4.1. Garanti Feragatnamesi (Hizmetin "Olduğu Gibi" Sunulması)

Kullanım Riski: Gruso'yu ve sunduğu Hizmetler'i kullanımınız tamamen kendi sorumluluğunuzdadır. Platform, size "olduğu gibi" ve "mevcut olduğu sürece" esasıyla sunulmaktadır.
Doğruluk Garantisinin Olmaması: Seyahat verilerinin, fiyatların ve rotaların güncel olması için azami çaba göstersek de; Üçüncü Taraf Seyahat Sağlayıcılardan (havayolları, oteller vb.) veya meteoroloji istasyonlarından anlık alınan içeriklerin, bütçe tahminlerinin ve akıllı paketleme tavsiyelerinin mutlak doğruluğu, eksiksizliği veya güvenilirliği konusunda hiçbir açık veya örtük garanti vermiyoruz.
Gruso; yürürlükteki yasaların izin verdiği azami ölçüde, mülkiyet hakkı, ihlal etmeme, satılabilirlik, belirli bir amaca uygunluk ve doğruluk gibi tüm örtük garantileri açıkça reddeder. Platform'un her zaman kesintisiz, güvenli, hatasız veya virüslerden arındırılmış olacağına dair bir taahhüt verilmemektedir.

4.2. Gruso Üzerinden Seyahat Planlama ve Rezervasyonlar

Aracı Rolü: Bölüm 1'de de belirtildiği üzere, Gruso bir seyahat acentesi değildir. Platform üzerinde listelenen uçuş, konaklama veya etkinliklerin fiyatlarını belirlemez veya kontrol etmez. Rezervasyon işlemlerini kolaylaştırıcı yönlendirmeler yapsa da, bu işlemler doğrudan ilgili Seyahat Hizmet Sağlayıcısı (hava yolu şirketi, otel vb.) ile sizin aranızda gerçekleşir.
Sağlayıcı Şartlarına Uyma: Satın alım yaptığınız firmanın kendi şart ve koşullarına (iptal, iade, bagaj kuralları vb.) tamamen uymakla yükümlüsünüz. Bu kuralların ihlali durumunda biletinizin iptali veya ek ücret doğması halinde Gruso'nun hiçbir yasal sorumluluğu veya arabuluculuk görevi bulunmamaktadır.
Bağlantılı Seyahat Düzenlemeleri: Platform'u kullanarak 24 saat içinde farklı sağlayıcılardan ayrı ayrı ürünler (örneğin önce uçuş, sonra otel) seçtiğinizde, bu durum yasal olarak bir "Paket Tur" koruması sağlamayabilir. Her bir hizmet sağlayıcının iflası veya kusuru durumunda haklarınızı doğrudan o sağlayıcıya karşı aramanız gerekir; Gruso bu süreçlerin hiçbir aşamasında taraf değildir.

BÖLÜM 5: ABONELİK MODELLERİ, ÖDEME VE CAYMA HAKKI (İADE) İSTİSNASI

5.1. Abonelik Modelleri ve Ücretlendirme

Ücretli Hizmetler: Gruso, bazı temel özellikleri ücretsiz sunabileceği gibi, yapay zeka destekli akıllı seyahat planlama, grup içi oylamalar, detaylı bütçe dökümleri ve gelişmiş asistanlık hizmetlerini ücretli abonelik modelleri ("Premium / Pro Üyelik") kapsamında sunmaktadır.
Ücret Değişiklikleri: Abonelik paketlerinin ücretleri, ödeme dönemleri ve kapsamı Gruso tarafından belirlenir ve Platform üzerinde ilan edilir. Gruso, abonelik fiyatlarında değişiklik yapma hakkını saklı tutar. Fiyat değişiklikleri mevcut abonelik dönemi içinde geçerli olmayıp, yenileme döneminden itibaren uygulanacaktır.

5.2. Ödeme ve Otomatik Yenileme

Ödeme Kanalları: Abonelik ödemeleri; uygulama içi satın alma kanalları (Apple App Store / Google Play Store faturalandırma sistemleri) veya Gruso tarafından belirlenen güvenli üçüncü taraf ödeme geçitleri aracılığıyla tahsil edilir.
Otomatik Yenileme: Kullanıcı aksini talep etmediği ve aboneliğini dönem sonundan önce iptal etmediği sürece, abonelikler seçilen periyoda göre (aylık/yıllık) otomatik olarak yenilenir ve kayıtlı ödeme yönteminden abonelik ücreti tahsil edilir. Aboneliğinizi dilediğiniz zaman ilgili uygulama mağazası (App Store / Play Store) ayarlarınız üzerinden bir sonraki dönem için iptal edebilirsiniz.

5.3. Cayma Hakkının Olmaması ve İade Politikası (Kritik Yasal Uyarı)

Dijital İçerik ve Anında İfa İstisnası: 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği'nin 15. maddesinin 1. fıkrasının (ğ) bendi uyarınca; "Elektronik ortamda anında ifa edilen hizmetler veya tüketiciye anında teslim edilen gayriaddî mallara ilişkin sözleşmeler" cayma hakkının istisnaları kapsamında yer almaktadır.

Cayma Hakkından Feragat: Gruso tarafından sunulan Premium seyahat asistanlığı hizmetleri, abonelik işlemlerinin tamamlanması ve ödemenin yapılmasıyla birlikte elektronik ortamda anında ifa edilmekte ve kullanıcının kullanımına sunulmaktadır. Bu nedenle Kullanıcı, Premium abonelik başlattığı andan itibaren cayma hakkının bulunmadığını, abonelik ücretinin iadesini talep edemeyeceğini peşinen kabul, beyan ve taahhüt eder.
Kısmi Kullanım/İptal Durumu: Kullanıcı'nın abonelik döneminin ortasında aboneliğini iptal etmesi durumunda, içinde bulunulan dönem için herhangi bir ücret iadesi yapılmaz. Kullanıcı, mevcut abonelik döneminin sonuna kadar Premium özellikleri kullanmaya devam edebilir; aboneliği bir sonraki dönem için yenilenmez.
Uygulama Mağazası Kuralları: Ödemelerin Apple App Store veya Google Play Store üzerinden yapıldığı durumlarda, Gruso'nun doğrudan teknik bir iade yetkisi bulunmamaktadır. Söz konusu mağazaların kendi kullanıcı sözleşmeleri ve iade politikaları geçerlidir.

BÖLÜM 6: SÖZLEŞMENİN FESHİ, YÜRÜRLÜK VE YETKİLİ MAHKEME

6.1. Sözleşmenin Feshi ve Hesabın Askıya Alınması

Kullanıcı Tarafından Fesih: Kullanıcı, dilediği zaman Gruso hesabını tamamen silerek veya mobil uygulamayı cihazından kaldırarak işbu sözleşmeyi tek taraflı olarak feshedebilir. Ancak Bölüm 5'te belirtildiği üzere, devam eden bir Premium aboneliğin feshi durumunda geçmişe dönük iade yapılmaz.
Gruso Tarafından Fesih ve Askıya Alma: Kullanıcı'nın işbu sözleşme maddelerinden herhangi birini (özellikle bot/scraping yasağı, grup içi uygunsuz içerik paylaşımı, tersine mühendislik vb.) ihlal etmesi veya ihlal ettiğine dair makul bir şüphe bulunması halinde, Gruso hiçbir ihbarda bulunmaksızın ve tazminat ödemeksizin kullanıcının hesabını geçici olarak askıya alma veya kalıcı olarak feshetme hakkına sahiptir.
Hizmetin Tamamen Sonlandırılması: Gruso, ticari veya operasyonel kararlar doğrultusunda Platform'un faaliyetlerini tamamen durdurma ve sözleşmeyi tüm kullanıcılar için feshetme hakkını saklı tutar.

6.2. Yürürlük ve Sözleşme Değişiklikleri

Yürürlük: İşbu sözleşme, Kullanıcı'nın Platform'a üye olduğu veya Platform'u kullanmaya başladığı andan itibaren tüm hüküm ve koşullarıyla birlikte yürürlüğe girer ve kullanıcı hesabı aktif olduğu sürece yürürlükte kalır.
Değişiklikler: Gruso, yasal mevzuattaki değişiklikler veya uygulamanın yeni özellikleri doğrultusunda bu sözleşme maddelerini zaman zaman güncelleyebilir. Güncellenen sözleşme Platform üzerinde yayınlandığı tarihte yürürlüğe girer. Sözleşmede yapılan önemli değişiklikler kullanıcılara uygulama içi bildirimler veya e-posta yoluyla bildirilecektir. Değişikliklerden sonra Platform'u kullanmaya devam etmeniz, yeni şartları kabul ettiğiniz anlamına gelir.

6.3. Uygulanacak Hukuk ve Yetkili Mahkeme

Uygulanacak Hukuk: İşbu sözleşmenin yorumlanmasında, uygulanmasında ve doğabilecek her türlü uyuşmazlığın çözümünde Türkiye Cumhuriyeti Hukuku uygulanacaktır.
Yetkili Mahkeme ve İcra Daireleri: İşbu sözleşmeden kaynaklanan veya sözleşmeyle bağlantılı olan her türlü uyuşmazlığın çözümünde, mevzuatın tüketici mahkemelerine tanıdığı zorunlu yetki sınırları saklı kalmak kaydıyla, Ankara Mahkemeleri ve İcra Daireleri münhasıran yetkilidir.
